RECOMMENDED ACTION:
Adopt a resolution rescinding Resolution No. 2022-103 and authorizing specified positions monetary settlement authority for general liability and workers' compensation claims.

body
BACKGROUND INFORMATION:
Resolution No. 2022-103, enacted in 2022, granted the City Manager, City Attorney and Risk Manager settlement authority for general liability claims. This resolution was adopted in unison with the amendment of Lodi Municipal Code Chapter 2.14 "City Attorney" to increase the purchasing authority for the City Attorney. However, the accompanying settlement authority resolution did not include workers' compensation claims settlement authority.

Staff currently does not have authority to settle workers' compensation claims without advanced City Council approval. This has proven ineffective in quickly, efficiently and adequately addressing disputes with claimants, which often fall under the dollar amount that staff would otherwise be able to settle an equivalent general liability claim at. Therefore, staff recommends rescinding Resolution No. 2022-103 and reenacting a new resolution to a set settlement authority limits for both general liability and workers' compensation claims at the current purchasing authority to $60,000 for the City Manager and City Attorney and $30,000 for the Risk Manager. This will allow for more efficient and cost-effective settlement solutions for the City.
