body
BACKGROUND INFORMATION:
The franchise agreement with USA Waste of California, Inc. dba Central Valley Waste Services, commonly known as WM (WM), includes billings and payments between WM and the City, including an Administration Fee of $1,000,000, payable over four years.

Section 9d of the franchise agreement requires payment of an Administrative Fee from WM to the City:

(d) WM will pay the City an administrative fee of $250,000 on or about April 1, 2024, April 1, 2025, April 1, 2026, and April 1, 2027.

The administrative fee was intended to be provided to the City to fund a Council-chosen project that improves our community and would otherwise not be funded in the near future. To date, the City has received two payments of $250,000, for a combined total of $500,000. Staff is scheduled to return to Council to present possible projects to utilize these funds in July 2025.

Transfer of $500,000, received from WM, from the General Fund, to General Fund Capital for Unspecified Capital Project, will ensure the funds are encumbered for their intended purpose and utilized to better our beautiful City and benefit our residents.

Staff recommends adopting a resolution authorizing fund transfer from General Fund to General Fund Capital for Unspecified Capital Project.
