BACKGROUND INFORMATION:
The Gateway South Neighborhood Park is located within the boundary of the Gateway South Subdivision, Unit No. 3, the third phase of a multi-phase residential development located west of Lower Sacramento Road and south of Century Boulevard, as shown on Exhibit A.
The original terms of the improvement agreement for the subdivision (approved by Council on August 18, 2021), required the developer, KDK Land Company, to execute a separate improvement agreement to construct the neighborhood park. The developer requested to execute an improvement deferral agreement in lieu of the improvement agreement required for the park improvements because the improvement plans for the park were not completed and acceptance of the subdivision would be delayed. The improvement deferral agreement was approved by Council on October 18, 2023 concurrently with the acceptance of the Gateway South Unit 3 subdivision public improvements and required the developer to enter into the separate park improvement agreement. The improvement deferral agreement required the developer to fully execute the park improvement agreement by December 31, 2024.
The Developer furnished the City with the improvement plans, necessary agreements, guarantees, insurance certificates, and the required fees for the proposed park improvements, specifically all park facilities and landscaping which were excluded from the Gateway South Unit 3 subdivision public improvements (Exhibit B).
Staff recommends authorizing the City Manager to execute an Improvement Agreement for the Public Improvements of Gateway South Neighborhood Park, Tract No. 4079 (Unit No. 3).

FISCAL IMPACT:
There will be an overall increase in long term maintenance costs for public infrastructure and City services such as police, fire, water, wastewater and parks, and open space maintenance associated with the new subdivision. Costs for park maintenance will be offset by proceeds from Community Facilities District No. 2007-1 (Public Services) as well as increased general tax revenues from new residents.
