BACKGROUND INFORMATION:

There are approximately 400 miles of sidewalk within the City of Lodi.  The State of California Streets and Highways code establishes that it is a property owner’s responsibility to maintain the abutting sidewalk in a condition that will not endanger persons or property nor interfere with public use.

On October 5, 2005, Council adopted a Sidewalk Maintenance Policy (Resolution 2005-218) which identifies certain sidewalk defects that will be remedied by the City at no cost to the adjacent property owner.  The sidewalk defects remedied by the City primarily include offsets that range between ¾” to 1 ½” or minor irregularities.  The overarching goals of the policy are to encourage walking and improve safety by reducing the number of defects in the sidewalk, improve the sidewalk system for persons with disabilities, and reduce the City’s liability exposure.

This project consists of grinding approximately 9,000 lineal feet of sidewalk offsets (between ½” and 1 ½”) at various locations throughout the City to eliminate tripping hazards.

On November 20, 2024 Council awarded the contract to Trip Hazard LLC, of Bay Point, CA in the amount of $97,560.00.  The final contract amount was $80,023.70, which is lower than the original contract amount due to multiple locations being pulled from the project scope. The removed locations were considered ineligible for grinding for one of the following reasons: offsets greater than 1 ½”, existing sidewalk was damaged (beyond the ability to grind), or the offset was fixed prior to start of project.  All work was completed in substantial conformance with the plans and specifications approved by City Council. A typical location photo is provided on Exhibit A.

Following acceptance by the City Council, as required by law, the City Engineer will file a Notice of Completion with the County Recorder’s office.  The notice serves to notify vendors and subcontractors that the project is complete and begins their 30-day period to file a stop notice requiring the City to withhold payments from the prime contractor in the event of a payment dispute.

STRATEGIC VISION:

5C. Infrastructure: Address deferred maintenance.

FISCAL IMPACT:

This contract will reduce the risk of liability associated with potential claims caused by tripping on uneven sidewalk and does not impact the General Fund.

FUNDING AVAILABLE:

This project was funded by Measure K.
