Adopt a Resolution authorizing City Manager to execute change orders to 2025-2027 Sidewalk and Miscellaneous Concrete Repair Program, in an amount not-to-exceed $400,000, and appropriating funds in the amount of $180,000.

BACKGROUND INFORMATION:
The City maintains an on-call contract for citywide sidewalk and miscellaneous concrete repair. This contract includes the construction, removal, and/or the replacement of curb, gutter, sidewalk, ramps, or other miscellaneous concrete items needed at various locations throughout the City on an as-needed basis. The contract is primarily utilized by the Streets Division of Public Works, but is also available for use by the Parks Department, and the Water/Wastewater, Transit, and Facilities divisions.
On April 16, 2025, Council approved specifications and adopted a resolution authorizing the City Manager to award a contract to the lowest responsive bidder, not-to-exceed $335,000 and execute change orders in an amount not-to-exceed $40,000.
On June 18, 2025, the City Manager executed the contract with Tom Mayo Construction, Inc., of Stockton, in the amount of $119,520.
On April 29, 2026, Change Order No. 1 was executed in the amount of $40,000, increasing the total contract amount to $159,520 and fully utilizing the City Manager’s existing change order authority.
Staff recommends increasing the City Manager’s change order authority by an additional $400,000, for a total change order authority of $440,000. This would increase the total contract amount to $559,520. This increase in change order authority is planned to fund the following scope:
• FY 2026/27 Sidewalk and Misc. Concrete Repair Needs ($230,000)
o Newly received State Transit Development Act (TDA) Bicycle and Pedestrian funds - $180,000
o Previously appropriated TDA Bicycle and Pedestrian funds - $50,000
• Site-Specific Concrete Repairs - $104,400
o Well #5 and Well #20 - $8,100
o Transit Station - $65,000
o Hale Park - $1,300
o Stockton Street/ Poplar Street curb ramps with Rectangular Rapid-Flashing Beacons -$30,000
After allocating $334,400 for the work identified above, the remaining change order authority of $65,600 will be available for other concrete repair needs requested by City departments and divisions.
Approval of the recommended action will also appropriate $180,000 in newly received TDA Bicycle and Pedestrian funds for the FY 2026/27 sidewalk and miscellaneous concrete repair work.
FISCAL IMPACT:
There are minimal long-term fiscal impacts associated with this project, however replacing hazardous and/or non-compliant concrete improves the health and safety of the community and reduces the City’s liability associated with that hazardous and/or non-compliant concrete.
FUNDING AVAILABLE:
Note: Any additional change orders beyond the accounts described above will utilize previously approved / appropriated operating accounts or will return to Council for appropriation.
