BACKGROUND INFORMATION:
The City’s wastewater treatment operations are regulated by multiple local, state, and federal agencies, including the California Regional Water Quality Control Board and the San Joaquin Valley Air Pollution Control District. Ongoing regulatory compliance requires specialized technical support related to wastewater discharge requirements, monitoring and reporting programs, permit compliance, biosolids and land application management, regulatory coordination, and operational support.
The City issued a Request for Qualifications (RFQ) for professional regulatory compliance consulting services to support the City’s wastewater treatment operations and associated regulatory requirements. The City received seven statements of qualifications from firms experienced in wastewater regulatory compliance and related environmental services. Qualifications were evaluated based on the criteria identified in the RFQ, including experience with similar facilities, technical expertise, project understanding, staffing resources, references, and overall responsiveness to the City’s needs.
Following a comprehensive evaluation of the submitted qualifications, staff determined that West Yost & Associates Inc., was the most qualified firm to provide the required services. West Yost has more than 25 years of experience providing wastewater regulatory compliance and permitting services for public agencies throughout California, including extensive work within the Central Valley. Their specialized technical expertise, experienced project team, and successful work on comparable wastewater facilities best meet the City’s needs.
The proposed agreement will provide regulatory compliance and permitting services necessary to support White Slough Water Pollution Control Facility (WPCF) and Recycled Water Land Application Program during this contract period for WPCF water and biosolids discharges currently regulated by the Central Valley Regional Water Quality Control Board (Regional Board) under the following discharge permits:
• Surface water discharges are regulated under the General Permit for Municipal Wastewater Dischargers that Meet Objectives/Criteria at the Point of Discharge to Surface Water (General Permit) Order R5-2023-0025 and site-specific Notice of Applicability (NOA) R5-2023-0025-010 for coverage under the General Permit, as well as Time Schedule Order (TSO) R5-2025-0091 that provides the City with additional time to comply with the NOA’s new, lower ammonia effluent limits compared to the prior NOA.
• The City’s recycled water uses and biosolids land application are regulated under Waste Discharge Requirements (WDRs) Order No. R5-2025-0046.
• Non-City uses of WPCF recycled water are regulated under the State Water Resources Control Board’s (State Water Board’s) Order WQ 2016-0068-DDW Waste Reclamation.
• Requirements for Recycled Water Use (General WRRs) and a revised site-specific NOA WQ-2016-0068-DDW-R5007 (Recycled Water NOA) issued by the Regional Board.
• Biosolids production and applications are also regulated under nationwide U.S. Environmental Protection Agency (USEPA) regulations.
The proposed agreement will provide professional regulatory compliance services for the City’s wastewater treatment operations, including but not limited to:
- Regulatory agency coordination and support;
- NPDES permit compliance assistance;
- Preparation and review of required regulatory reports;
- Monitoring and compliance program support;
- Land application and biosolids management assistance;
- Support during inspections and enforcement actions;
- Technical review of operational and compliance issues;
- Assistance with permit renewals and amendments; and
- Other related regulatory and environmental compliance services as needed.
The agreement will provide continuity of regulatory support services necessary to maintain compliance with applicable permits and regulatory requirements while supporting ongoing wastewater treatment operations.
The proposed agreement is for a three-year term for Fiscal Years 2026/27 through 2028/29 in the amount not to
exceed $694,600, with two optional one-year extensions subject to mutual agreement of the parties and future
budget appropriations.
FISCAL IMPACT:
The proposed agreement will be funded through the Wastewater Operating Fund and will not impact the General Fund. Maintaining compliance with the wastewater discharge permit requirements reduces the City’s risk of regulatory enforcement actions and potential penalties.
FUNDING AVAILABLE:
Fiscal year 2026/27 funds were approved as part of budget adoption in the Wastewater Operating Fund (53053003). Subsequent fiscal year needs will be presented as part of budget planning each fiscal year.
