BACKGROUND INFORMATION:
The scope of this project is to remove and replace existing, deteriorated, concrete sealant at the Lodi Transit Station parking structure stairs. The existing stair sealant is failing, allowing water intrusion into the structure (the World of Wonder’s classroom) below. The City received the following two bids for the project on November 5, 2025.

Following the bid opening, staff suspected a major error was made in the bid submitted by Paine Construction, indicated by the substantial difference in the bids received, and the Engineer’s estimate. Staff contacted Paine Construction to discuss their bid, where they confirmed the error and further requested withdrawal of their bid.
Staff recommends adopting a resolution authorizing the return of the bid to apparent low bidder (Paine Construction, Inc.) for the Parking Structure Stair Re-sealing project due to a substantial bidding error, and awarding the contract to the second lowest bidder, Waterproofing Associates, Inc. of Lodi.

FISCAL IMPACT:
The project will reduce annual maintenance costs and claims associated with the repaired defects. This project does not impact the General Fund.
