body
BACKGROUND INFORMATION:
The Lodi City Council approved an Administrative Policy in 2015 that provides paid sick-leave benefits for part-time, temporary, and season employees as required by Assembly Bill No. 1522 (“AB 1522”), referred to as the Healthy Workplaces, Healthy Families Act of 2014. This law entitles an employee to paid sick days for certain purposes, if the employee works in California for the same employer for 30 or more days within a year. Under AB 1522, an employer must provide up to 3 days of paid sick leave per year and may choose to front-load the full annual accrual amount each January or implement an alternative accrual method. The City of Lodi elected to implement the accrual method whereby part-time, temporary or seasonal employees accrue one hour of paid sick leave for every 30 hours worked, up to a maximum of 48 hour of accrued sick leave.
Senate Bill No. 616 (“SB 616”), signed on October 4, 2023 and went into effect on January 1, 2024, enhances these benefits, increasing the entitled sick leave benefits and increasing the amount of sick leave that can be taken each year. SB 616 does not change the accrual rate; however, it is does increase the maximum accrual cap of 48 hours under AB 1522, to 80 hours. Additionally, part-time, temporary and seasonal employees are entitled to take up to 40 hours of paid sick leave each year instead of the prior limit of 24 hours under AB 1522.
Regular full-time employees are provided paid sick leave benefits that exceed the minimum accrual as required under AB 1522 and SB 616; therefore, this policy does not apply to full-time employees.
The amendments to the Sick Leave Benefits for Part-time, Temporary, or Seasonal Employees policy are intended to satisfy the requirements set forth under AB 1522 and SB 616.
