RECOMMENDED ACTION:
Adopt a resolution ratifying expenses and authorizing City Manager to execute change orders to State Route 99/Turner Road Interchange Project ($63,260) and accept improvements under contract for State Route 99/Turner Road Interchange Project.
body
BACKGROUND INFORMATION:
The final project improvements included the construction of a round-a-bout located near the southerly end of the southbound Turner Road freeway off-ramp, widening Cherokee Lane into a two-way facility between Pioneer Drive and Turner Road, including Class II bike lanes in both directions and sidewalk on the westerly side of the roadway. The project also included lengthening the SR99/Turner Road southbound on-ramp by 400 feet.
On October 19, 2022, City Council authorized the award of State Route 99/Turner Road Interchange project to O.C. Jones & Sons, Inc. of Berkeley in the amount of $5,890,182.90. The authorization also allowed the City Manager to execute change orders up to $900,000. On March 20, 2024, City Council authorized the City Manager to execute additional change orders in an amount not-to-exceed $200,000 for a total change order authority of $1,100,000. At this time, staff anticipated this request would accommodate additional costs to complete the project.
The work started in February 2023 and was completed on December 15, 2023 in substantial conformance with the specifications approved by the City Council. As typical with interchange improvement projects serving the State Highway System, work was impacted by continuously changing conditions that resulted in several change orders. There were twenty-six change orders that authorized a total of $1,213,244.36 in additional work. The actual amount of change orders utilized was $999,637.97. Additionally, there were $163,617.60 of approved bid line item adjustments. The total amount of additional work completed beyond the original contract amount is $999,637.97 + $163,617.60 or $1,163,255.57 resulting in a final project cost of $7,053,438.47 (Exhibit A).
Since the Council actions noted above limited the City Manager change order authority to $1,100,000, staff is requesting Council ratify the additional $63,255.57 in expenditures that exceeded the current $1,100,000 limit. A photo of the completed project is shown in Exhibit B.
Following acceptance by the City Council, as required by law, the City Engineer will file a Notice of Completion with the County Recorder’s office. The notice serves to notify vendors and subcontractors that the project is complete and begins their 30-day period to file a stop notice requiring the City to withhold payments from the prime contractor in the event of a payment dispute.
STRATEGIC VISION:
5. Infrastructure: Develop and maintain a robust infrastructure to support a World class city.
FISCAL IMPACT:
The project will have minor additional landscape and roadway maintenance costs. In addition, a future, wine oriented public art monument will be located at the center of the round-a-bout intended to welcome visitors and promote business development. The project had no impact to the General Fund.
