RECOMMENDED ACTION:

Adopt a resolution authorizing the Lodi Police Department to participate in the Cannabis Tax Fund Grant Program Funded by the California Highway Patrol (CHP), approving the execution of the grant documents by the Chief of Police on behalf of the City of Lodi, and appropriating funds in the amount of $92,061.33.

body

BACKGROUND INFORMATION:

With the passage of Proposition 64, The Control, Regulate, and Tax Adult Use Marijuana Act (“AUMA”) in 2016, California voters mandated the State of California (“State”) set aside funding for the California Highway Patrol (“CHP”) to disperse to local governments and qualified nonprofit organizations for the education, prevention, and enforcement of impaired driving laws, pursuant to Revenue and Taxation Code Section 34019(f)(3)(B).

CHP works closely with state and local agencies and other traffic safety stakeholders to actively address impaired driving.  The CHP considered a variety of factors in determining specific needs for each grant, including opportunities and projects best suited to prevent the loss of life, injuries, and property damage caused by driving under the influence of alcohol and/or drugs.  The purpose of the Cannabis Tax Fund Grants Program (“CTFGP”) is to provide funds to augment, but not supplant, current DUI activities and programs.

Staff requested funding to purchase a truck to be used in DUI saturations and checkpoints. A saturation patrol involves officers dedicated to patrolling a specific area looking for impaired drivers. The new pickup truck is an essential upgrade, providing the towing capacity needed for DUI checkpoints and a secure space to transport arrested individuals-functionality not achievable with motorcycles or other existing vehicles. The truck's cargo bed can be used during marijuana grow investigations and transporting necessary equipment and evidence.

Staff requested funding for overtime and benefits, as those funds will support one DUI checkpoint and six saturation patrols. These are separate and in addition to current California Office of Traffic Safety (“OTS”) funding the City currently receives on an annual basis. The checkpoint and saturation patrols will be deployed to areas where statistical data shows a greater likelihood of DUI drivers. They will be operated by employees trained in Standard Field Sobriety Test (“SFST”) and/or Advanced Roadside Impairment Detection Enforcement (“ARIDE”).

By adopting this resolution, the City will receive $92,061.33 in grant funding from the  CHP to purchase and upfit a truck for DUI and traffic enforcement and personnel costs to operate DUI checkpoints and DUI saturation activities. The project aims to reduce drug and alcohol related fatal and/or injury collisions.
