body
BACKGROUND INFORMATION:
The requested action will amend the zoning ordinance (also known as the Development Code) and address the first phase of code changes needed to create consistency with the Lodi General Plan. This is proposed in accordance with state law (Government Code §65860) that requires a city’s zoning ordinance to be consistent with its General Plan, which is the overarching policy and community vision for a how a city intends to grow itself. Additionally, changes to the Development Code are recommended to address recently approved state planning law that supersedes any portion of City code and provide further streamlining of existing processes, including those related to the Council-approved Planning Fee Update, and a handful of clean-up items for clarification purposes. Key proposed changes include the following:
• Provisions for ministerial review of certain allowable land uses.
• Clean-up of targeted items for clarification.
• Streamlining of various permits shown in Allowed Uses and Permit Tables 2-6, 2-8 and 2-10.
• Establishment of development standards for Parking facilities/vehicle storage, Auto sales and rental, and Storage Indoor (mini-storage facilities).
Table 1 below summarizes the individual LMC Sections being amended, listed by Development Code Section numbers, title, subject matter, reason for the amendment, and supporting General Plan policies.
Table 1 - Development Code Amendment Summary

On December 13, 2023, the Planning Commission recommended that the City Council approve the proposed code amendments referred to as the first phase (“Phase-1”) of Development Code amendments that includes revisions to multiple sections of the code (Attachment A). The proposed code revisions are shown in redline/strikeout format over the existing code in Attachment B.
