body

BACKGROUND INFORMATION:

Edible food recovery means collecting edible food that would otherwise go to waste and redistributing it to feed people in need. This is the highest and best use for food that would otherwise go to waste. Feeding hungry people through food recovery is the best use for surplus food and a vital way for California to conserve resources and reduce waste thrown in landfills.

Senate Bill (SB) 1383 requires that by 2025, California will redirect 20 percent of edible food that would otherwise be sent to landfills toward feeding people in need. The law directs the following:

•                     Jurisdictions must establish food recovery programs and strengthen their existing food recovery networks;

•                     Food donors must arrange to recover the maximum amount of their edible food that would otherwise go to landfills;

•                     Food recovery organizations and services that participate in SB 1383 must maintain records.

In accordance with Lodi Municipal Code Section 13.16.230, the City or its designee may inspect all premises within the City to determine compliance with and enforce the relevant provisions of Chapter 13.16 (Solid Waste). The County, through its Environmental Health Department, offered to conduct on-site inspections and records review pursuant to the City’s SB1383 Edible Food Recovery Program on behalf of the City within the City jurisdiction.

Consistent with the Lodi Municipal Code, the proposed Memorandum of Understanding between the City and the County designates the County as the entity assigned and authorized to fulfill the City’s regulatory responsibilities under the Edible Food Recovery Program. This arrangement will significantly reduce overhead costs to the City and the County by leveraging economies of scale.

Staff recommends authorizing the City Manager to execute a Memorandum of Understanding between City of Lodi and San Joaquin County for inspection services related to City’s Edible Food Recovery Program.

STRATEGIC VISION:

3A. Fiscal Health: Promote City's transparency & fiscal fluency.

FISCAL IMPACT:

The County proposes to perform the inspections free of charge to the City. The County may by resolution directly charge each individual commercial edible food generator a reasonable fee to recoup its costs to implement the inspection and recordkeeping provisions of the Edible Food Recovery Program.
