Adopt a Resolution Authorizing the Interim City Manager to Execute Amendment No. 5 with West Yost & Associates, Inc of Davis, for Fiscal Year 2025/26 Regulatory Engineering Services at White Slough Water Pollution Control Facility in the amount of $60,000.

BACKGROUND INFORMATION:

The scope of work covers regulatory related support efforts and anticipated requirements under discharge permits issued by the Central Valley Regional Water Quality Control Board (Regional Board), including the General Permit for Municipal Wastewater Dischargers and associated site-specific Notices of Applicability, Waste Discharge Requirements, and State Water Resources Control Board orders governing recycled use.

 

The original professional services agreement with West Yost & Associates, Inc. was executed on September 1, 2020, in the amount of $193,700, to provide regulatory engineering services in support of compliance activities at the White Slough Water Pollution Control Facility.

 

Amendment No.1 was executed on April 12, 2021, increasing the not-to-exceed amount by $62,100, for a revised total contract amount $255,800. This amendment adjusted the scope of work to address expanded regulatory needs.

 

Amendment No. 2 was executed in October 12, 2021, increasing the not-to-exceed amount by $47,600, for a revised total contract amount of $303,400, and continued regulatory support services associated with permit compliance activities.

 

Amendment No. 3 was executed on August 18, 2022. This amendment extended the term of the agreement through June 30, 2024, increased the not-to-exceed amount by $413,100, for the revised total amount of $716,500, and expanded the scope of services to include additional State regulatory requirements.

 

Amendment No. 4 was approved on October 8, 2024, and replaced a previously approved version to correct a minor error related to the fee amount. This amendment extended the term of the agreement through June 30, 2026, increased the not to exceed amount by $387,400, and revised the total contract amount to $1,103,900. Aside from the extension, no substantive changes were made to the scope of services.

 

Amendment No. 5, if approved, would authorize continued regulatory support services for the remainder of Fiscal Year 2025-26, in the amount not-to-exceed $60,000, revising the total contract amount to $1,163,900. This amendment provides continuity of ongoing regulatory assistance necessary to meet existing permit requirements. This action will not extend the term.

 

Staff will initiate a Request for Qualifications (RFQ) for future regulatory services prior to the expiration of this contract.

 

The following scope of services summarizes the primary regulatory support activities for Fiscal Year 2025-26:

 

Project Management:

This task includes project management related activities, including project initiation, general project coordination, and development and review of project invoices.  Under this task, brief descriptions of services performed will be developed and included with monthly invoices.

 

Regulatory Program Management: 

Continued ongoing assistance related to understanding complex regulatory compliance issues, implementing the measures needed to achieve compliance and provide assistance to the City as needed in developing responses to Regional Board requests.

 

Land Application Monitoring Coordination: 

Review land application monitoring data and development of the Annual Cropping and Irrigation Reports.  Review of the monthly land application reports under the WDRs.  Prepare online Annual Biosolids Application Report, required by the USEPA and prepare various recycled water reports required to document tertiary pond activities.

 

Groundwater Reporting Support:

Includes support with developing quarterly and annual groundwater monitoring reports.  West Yost will prepare draft and final quarterly reports, including figures depicting the quarterly groundwater contour information.

 

WDRs Adoption Support:

West Yost will complete a review of the Administrative Draft Order and Tentative Draft Order.  These reviews will include a thorough read-through the orders for errors or concerns relative to the City’s current permit and other recent, similar permits issued by the Regional Board and development of a comment document on the City’s behalf.

 

Monitoring Well Network Modifications:

To support adoption of the monitoring network modifications being requested in the recent Report of Waste Discharge (ROWD). West Yost will manage and oversee the well destruction activities and construction of a new monitoring well WSM-17R. West Yost upon completion of the project will prepare a Monitoring Well Destruction Report to the Regional Board.

 

As-Needed Support Services:

This task allows Staff the flexibility to request additional support services from West Yost related to WSWPCF planning or design efforts or coordinating efforts between permit-related studies and other WSWPCF planning/design related issues.  This task provides for as-needed support to the City for such efforts.

 

Staff recommends authorizing the Interim City Manager to execute Amendment No. 5 with West Yost & Associates, Inc., of Davis, for regulatory engineering services at White Slough Water Pollution Control Facility, in the amount not-to-exceed $60,000.

 

FISCAL IMPACT:

This contract has minimal long-term fiscal impacts, however these regulatory services are necessary to maintain the city’s permit to operate our wastewater treatment facility.

 

FUNDING AVAILABLE:

This contract, including Amendment No. 5, is paid for out of Wastewater (White Slough) Operations previously approved in the Fiscal Year 2025-26 Budget.
