Consider adoption of the resolution authorizing the Interim City Manager to enter into a concession lease agreement with Galt Fuel, LLC for a portion of Lawrence Park located at 350 N. Washington Street, Lodi.

BACKGROUND INFORMATION:
The City of Lodi is the owner of the property located at 350 N. Washington Street in Lodi, currently designated as park land and known as Lawrence Park. Adjacent to the City-owned property is the American Legion Memorial Building which is located at 320 N. Washington Street and owned by Galt Fuel, LLC (“Legion Building”).
The Legion Building is going through significant renovations to be repurposed as event space and become another amenity for the Lodi community. To further enhance the Legion Building improvements, Galt Fuel LLC, is requesting that the City lease approximately 5,400 square feet of land from the Lawrence Park property located 350 N. Washington Street. This would allow Galt Fuel LLC to construct and maintain an enclosed dining and entertainment patio and related improvements on the southern end of their property.
The following are key terms of the lease agreement:
Landlord: City of Lodi
Tenant: Galt Fuel, LLC
Location: 350 N. Washington Street, Lodi CA
Size: 5,400 square feet
Term: 15 years maximum
Rent: $500.00 annually
Repairs and alterations to the premises: Tenant acknowledges that the City is not obligated to make any repairs whatsoever to the premises or to replace any components of the premise under any circumstance. Upon the expiration or earlier termination of the lease, the premises shall be delivered to the City in good repair and condition.
Insurance: Maintained by tenant
Reimbursement for appraisal and outside legal fees will be required upon execution of the Concession Lease Agreement.
By entering into the Concession Lease Agreement (Attachment 1), the City preserves ownership of the land while enabling private investment to enhance the adjacent property and community amenities, which will remain consistent and compatible with the City’s Lawrence Park uses.
FISCAL IMPACT:
Receive annual lease payment.
