RECOMMENDED ACTION:
Adopt a resolution awarding the contract and authorizing the City Manager to execute an agreement with Bobo Construction, Inc. ($9,866,433), and execute change orders up to ($600,000) for Construction of the Lodi Access Center and Emergency Shelter (Access Center) and execute a professional services agreement for construction management and construction testing to Bickford Ventures, Inc. a California corporation doing business as Division 1 Construction Management Services ($182,200) and Special Inspection Services to Terracon ($30,020).

BACKGROUND INFORMATION:
Available funds based on previous City Council Actions accepting awarded grants and appropriating/allocating funds, includes approximately $10.6 million for the General Contractor award for construction of the Access Center and $4.5 million for the operations over the next several years which encompasses a year of temporary operations and just over a year of permanent operations through November 30, 2026.
On November 4, 2020, the City Council adopted the San Joaquin Community Response to Homelessness - 2020 San Joaquin Strategic Plan (“Strategic Plan”).
The Strategic Plan includes goals and strategies developed from community feedback, which includes increasing access and reducing barriers to homeless crisis response services.
On April 7, 2021, City Council accepted the Permanent Local Housing Allocation (PLHA) grant of approximately $2 million, allocated primarily towards the Access Center. On May 5, 2021, Council approved allocating $5.5 million of American Rescue Plan Act federal funds to the development of a Navigation Center, now known as the Access Center. On May 5, 2021, City Council also approved the Lodi Access Center Community Engagement Plan, which was the first step in order to move forward with several of the goals identified in the Strategic Plan. On July 13, 2021, the County Board of Supervisors approved $2 million towards our Access Center project development and $800,000 towards our temporary emergency shelter site development from the San Joaquin County (County) capital-outlay fund. On October 6, 2021, City Council approved the Access Center location at 710 N. Sacramento Street in Lodi. On December 13, 2024 after a heartfelt presentation by City Staff, Council Members, and Lodi Committee on Homelessness Members the BOS awarded the City an additional $8.2 million to complete the Lodi Access Center Project and the Learning Center (AKA Workforce Education Center).
On January 16, 2024, a new value engineered design was presented to City Council and updated plans were submitted for permitting and final approvals were received for building permits on November 4, 2024.
Access Center Construction Bids:
On September 4, 2024, City Council approved plans and specifications and authorized advertisement for bids for the Access Center Project. On October 16, 2024, the Community Development Department released the advertisement for bids. The City received and publicly opened the following bids on November 13, 2024:

Access Center Construction Management Request for Proposals:
Staff issued a request for proposals to four local construction management firms on June 20, 2024, and received proposals from two on July 5, 2024. Based on the proposals received, Staff recommends Division 1, to perform construction management, construction testing and inspection services for the Lodi Access Center and Emergency Shelter as the lowest qualified bidder. Division 1 will provide inspectors who will work under the direction and supervision of City staff to provide quality control inspection and documentation of the daily work activities to ensure compliance with contract requirements. The total contract amount will be based on time and materials expended with a not-to-exceed limit of $182,200.
Additionally, Terracon is an approved vendor by the City of Special Inspection Services and has provided a quote for testing and inspection services for the Access Center construction in the amount of $30,020.
Encumbrance Timeline:
City allocated and San Joaquin County awarded ARPA funds must be encumbered by December 31, 2024 or the City risks losing the funds. Due to the exigent nature of getting funds encumbered, Staff has called a special City Council meeting to award the construction bid, construction management, and special inspection services for the Access Center based on lowest responsive bidders.

FISCAL IMPACT:
Capital Project
City Council approved $10.6 million in funding for construction of the Access Center as part of the City Access Center Capital Improvement Project in the FY 2024-25 Budget.
Operations
Future operations for the permanent Access Center and Emergency Shelter are estimated at minimum to be $2.8 million dollars annually based on The Salvation Army’s bid to operate the Center at the current bed count and contracted inflation. Should the occupancy of the shelter be expanded, which full construction will allow, annual operating costs would increase. Actual costs for operations will be based on fixed costs and occupancy as defined in the future contract between the City and operator.
FUNDING AVAILABLE:
ARPA - 22001.Contracts - $10.6 million (Capital), $4.5million (Temp Operations until facility opens), and (Permanent Operations - 14 months)
All ARPA funds related to Access Center for both capital and operation are obligated under the umbrella of the ARPA-22001 Capital Improvement Program Account and no budget adjustments are being requested.
