RECOMMENDED ACTION:
Receive an oral report from the Assistant City Attorney and adopt a Resolution appointing James Lindsay, a Retired PERS Annuitant, to Acting City Manager pursuant to Government Code section 21224(a) and a written PERS Annuitant Employment Agreement.

BACKGROUND INFORMATION:
At the Lodi City Council Special Meeting on April 30, 2025, Council directed an item to be placed on a City Council agenda to consider the appointment of James Lindsay, a retired PERS annuitant, to Acting City Manager for extra help to perform work of a specialized skill for a limited duration.
Mr. Lindsay has served as the City Manager of Saratoga for ten (10) years and in other high-level city positions. Mr. Lindsay will utilize his expertise as a former City Manager and Department Director, which is critically important for the City while its permanent City Manager is on administrative leave.
Mr. Lindsay desires to accept the appointment and the employment as the City’s Acting City Manager and will be compensated at $140 per hour.
